When Zoning Changes Threaten Home Businesses, AGPROfessionals Steps In

Our Review of Proposed Zoning Changes Reveals the Potential Removal of Home Businesses from Four Residential Zone Districts

The AGPROfessionals Land Use and Planning team closely monitors zoning codes across the counties where our clients live and operate. Maintaining open communication with county staff allows us to identify potential changes that could impact local residents, landowners, and businesses.

When proposed updates to the Weld County Zoning Code were introduced earlier this year, our team took notice, and our review helped protect hundreds of small, home-based businesses from unintended restrictions.

Participation in County Work Sessions

In July and August 2025, the Weld County Board of County Commissioners held work sessions with county staff to discuss Ordinance 2025-11, Chapter 23. AGPROfessionals attended these sessions to review the proposed zoning changes.

At the time, staff did not mention any changes to where home businesses would be permitted. Overall, our team supported most of the proposed updates to Chapter 23 of the Zoning Code. However, our subsequent review revealed a significant issue.

Calling Attention to Critical Omissions

Before the ordinance reached the Planning Commission, AGPROfessionals conducted a detailed review of the draft code. During this process, our team discovered that home businesses had been removed as a permissible use from the R-2 through R-5 Residential Zone Districts, a change that could have affected countless entrepreneurs operating from their homes.

We immediately raised the concern in a written communication to the Planning Commission, stating:

“We appreciate the changes being proposed by the Planning Department and believe they will benefit the county. One concern we have is the home businesses being taken away from the Residential (R-2 through R-5) zone districts. The removal of these uses from possible residential sites wasn’t discussed previously in the work sessions, and we believe this zoning permit shouldn’t be taken away from other homeowners.”

After hearing our concerns, the Planning Commission agreed that the proposed code needed additional review. In response, planning staff revised the language to restore home businesses as a permissible use in all residential zone districts before forwarding the amendment to the Board of County Commissioners. This collaborative effort ensures home-based business owners across Weld County can continue operating without unnecessary risk or disruption.

Ongoing Vigilance

While this outcome marks a significant win for Weld County home businesses, the zoning code must still pass three additional readings before final approval by the Board of County Commissioners. AGPROfessionals will continue to monitor each stage of the process to ensure that the updated code remains fair and supportive of local residents and small business owners.
