Successful agricultural projects rarely happen by accident. They require technical expertise, regulatory knowledge, and strong working relationships with the agencies and officials responsible for approving them.

In 2023, AGPROfessionals worked alongside officials in a county in Southern Idaho as the county reviewed and updated its concentrated animal feeding operations (CAFO) code requirements. At the time, our goal was to help ensure the revised regulations remained practical for agricultural producers while addressing community and regulatory needs.

That work recently proved valuable when a dairy producer needed assistance navigating the updated requirements and maintaining compliance as their operation continued to evolve.

Staying Compliant Over Time

Agricultural operations are not static. Facilities expand, herd sizes change, infrastructure is upgraded, and operational needs evolve over time. As these changes occur, producers must ensure they remain compliant with local land use regulations and permitting requirements.

At the same time, counties periodically update land use codes to address changing community priorities, environmental considerations, and development pressures. While these updates can open new opportunities for agricultural operations, they also require careful navigation to ensure compliance with revised regulations

When this dairy needed to verify compliance under the updated code and confirm acceptance of previously established setbacks, AGPROfessionals was ready to help.

What Was Involved

AGPROfessionals coordinated planning, engineering, agronomy, and permitting expertise throughout the approval process, supporting the client from initial evaluation through final approval.

As part of preparing the CAFO Amendment application, our team developed an updated site plan, completed a comprehensive review of the applicable land use regulations, prepared the required application materials, and assembled the supporting technical documentation, including an updated Nutrient Management Plan (NMP), water evaluation, and ISDA Siting Team request. During this review, AGPROfessionals identified that a county variance would be required to recognize the facility's previously established setbacks. Our team prepared the Land Use Application and supporting materials necessary to obtain the variance in addition to the CAFO Amendment.

As part of the county's review process, AGPROfessionals attended the Idaho State Department of Agriculture (ISDA) Siting Team inspection. Siting Teams are typically ad hoc, multi-agency groups that evaluate CAFOs for environmental risks and site suitability and provide recommendations to local officials as part of the permitting process.

AGPROfessionals also represented the client during the public hearing, ultimately securing approval of both the CAFO Amendment and the Variance.

Our involvement in a 2023 CAFO code revision process helped establish a foundation that benefited not only the client we represented at the time but also future producers working under those updated regulations. When this dairy operation later needed assistance obtaining a variance, updating its NMP, completing a water evaluation, and securing approval for its CAFO Amendment, our familiarity with the code, the process, and the local decision-makers helped move the project forward efficiently.
